2.1. Wheel of Games is an internet portal focusing on providing on-line informations, trends and news on all that relates to PC and video games. So as to be always up to date, users are offered the possibility to subscribe to a newsletter. In addition, users may subscibe to a newsletter in order to receive cutting-edge information.
2.2. After a registration at Wheel of Games, all services for participating actively on the portal are available to the user. This includes discussion forums, chat rooms, commentary pages and other.
2.3. Wheel of Games provides a collection of links to sales platforms of third party businesses. As long as services of any such business are being used, their respective terms of service are binding. Two Pi Team / Wheel of Games only supply the means of contacting a selling platform of a third party, without appearing as a seller themselves.
2.4. Two Pi Team / Wheel of Games will hold raffles and competitions where users are invited to participate. Please note that the drawings will be without engagement. Employees of Two Pi Team / Wheel of Games and their relatives are principally excluded from participation. Every natural person of age may participate. As far as minors are not already excluded of participation, they need to obtain the consent of their parents. Cash payment instead of material prizes is not possible. We explicitly state that any usage of Two Pi Team / Wheel of Games services or partner services will in no way influence your chances of winning. By participating at our games the user accepts their separate, special conditions of participation.
Two Pi Team / Wheel of Games will not warrant actuality, correctness, completeness or quality of provided informations. Liability claims against Two Pi Team / Wheel of Games […] for any damages which result from usage or non-usage of featured contents and defective or incomplete informations, respectively are principally excluded provided that there is no verifiably premeditated fault or negligence on Two Pi Team’s / Wheel of Games’ side. This applies to all forms of material or immaterial damage, and in particular to damage originating from errors, delays or interruptions in transmission, and moreover in case of disturbances of technical facilities, equipment and service, in case of defective contents, in case of loss or deletion of data, of viruses or as a result of other circumstances, when using this online offer. All offers are without engagement or obligation. Two Pi Team / Wheel of Games expressly reserves the right to modifiy, add, delete or cancel the publication of portions or all of of their sites or offers.
In case of direct links or indirect referrals to contents of third party sites ("hyperlinks") for which solely the respective provider is responsible, Two Pi Team’s liability obligation will only enter into force if Two Pi Team has had prior knowledge of an illicit content and moreover if it would have been technically possible and reasonable for Two Pi Team to prevent the usage thereof. Two Pi Team / Wheel of Games hereby expressly state that at the point of setting links, no illegal or tortious content on the linked sites were noticeable. Two Pi Team / Wheel of Games have no influence over actual or future design, content or authorship of the linked sites and therefore expressly disassociate themselves from all contents of any linked sites that were modified after the links were set. This statement includes every link and referral set within Two Pi Team’s / Wheel of Games’ own web offerings as well as third parties’ entries in guestbooks, discussion forums, lists of links or e-mails or any other forms of databases provided by Two Pi Team / Wheel of Games on which external writing access is possible. In case of illicit, defective or incomplete content and in particular concerning harm resulting from usage or non-usage of any such displayed information, only the provider of the referred-to page is to be held responsible, not however the user who referred to the corresponding publication by setting a link.
5.1. The user commits to a lawful usage of Two Pi Team’s / Wheel of Games’ services.
5.2. The user warrants the truthfulness and completeness of the data given upon his registration. Modifications of necessitated data will immediately be conveyed by the user to Two Pi Team / Wheel of Games. If the user should fail to meet this obligation he will be responsible for any resulting harm done to himself or to Two Pi Team / Wheel of Games and their partners.
5.3. The user commits to carefully guard his user name and password and to shield them from access by a third party. If the user should fail to meet this obligation he will be responsible for any consequential harm done to himself or to Two Pi Team / Wheel of Games and their partners that result from an abuse of his data by a third party.
5.4. The user agrees that Two Pi Team / Wheel of Games may collect and process personal data which were given for the ground, content-related configuration or modification of the contractual relationship with Two Pi Team / Wheel of Games, for the purposes of consultation, advertisement, marketing research or for need-based design of their services. The user may at any time disagree with the abovesaid by sending a written notification to Two Pi Team / Wheel of Games.
5.5. The user is liable for contents uploaded by him and warrants that those contents are either free from third party rights and that he is the holder of rights or may legally dispose of the owner’s property, respectively (particularly as regards copyrights and related rights, all trademark rights and naming rights). The user warrants not to distribute any indictable contents and furthermore ensures not to violate any third party rights (notably industrial property rights, copyrights, competition law and personality right) within his usage of Two Pi Team’s / Wheel of Games’ services (in particular as regards discussion forums, chats and comments). Above all, the distribution of any content that corrupts the youth, displays (child) pornography or is obscene, extremist, demagoguery, racist, threatening, defamatory or abusive is strictly prohibited. Two Pi Team / Wheel of Games reserve the right at any moment to remove content from the discussion forums, chat rooms and commentaries should it violate applying legal regulations, in particular should it be offensive and indecent, be contrary to the good manners of public communication or impede the regular communication between users. This applies to third party advertisements or references and links to such that are not authorised by Two Pi Team and not agreed with Two Pi Team, respectively. The user guarantees that he will not convey information, software or other material which includes a virus, defect, manipulation or similar harmful content. The user guarantees too that he will neither restrict nor prohibit other visitors’ free access to the site.
5.6. Should Two Pi Team / Wheel of Games gain knowledge of an illegal action or should Two Pi Team / Wheel of Games be notified of an alleged illegal action through a third party, we will, within the scope of legal regulations, convey personal data to criminal prosecution. If legal regulations should demand an examination of the lawfulness of either the transfer or the objectionable action through Two Pi Team / Wheel of Games, we will meet this obligation.
5.7. By publishing contents the user warrants that he is the sole holder of all and every respective right, in particular of the copyright. By feeding in content on the sites of Two Pi Team / Wheel of Games, for example by using forums or chat rooms, the user irrevocably and freely transmits to Two Pi Team / Wheel of Games all temporally, materially and spatially unlimited servitude and exploitation rights. In particular, this includes the rights of reproduction and of distribution, as well as all broadcasting rights and the right of playback or reproduction on image and sound carriers. Above all, the user agrees to Two Pi Team / Wheel of Games transmitting these servitudes to a third party in a given context of application. If a user should not be the holder of rights of any content he set in, he guarantees of having effectively obtained every necessary licence, permit, consent, and transfers of right etc. [...]
5.8. In case of any contravention, disruption of the system or inexpedient or prohibited usage, Two Pi Team / Wheel of Games reserves the right to irrevocably and without prior notice expel the corresponding user from their services. Furthermore, Two Pi Team /Wheel of Games is entitled to remove users’ posts without giving reasons.
5.9. The user indemnifies Two Pi Team / Wheel of Games from all claims of first request that were layed against Two Pi Team / Wheel of Games on the basis of a user’s infringement or of that of an associated third party.
Two Pi Team / Wheel of Games endeavour to respect the copyrights of all published images, graphics, sound documents, video sequences and texts and to chiefly use their own material or to refer to licence-free material. All trademarks mentioned within the internet offerings are unconditionally subject to regulations of respectively applying trademarks rights and the proprietary rights of their corresponding registered owners. Merely stating its name does not imply that the trademark is not protected by any third party rights. The copyright for published objects created by Two Pi Team / Wheel of Games as well as for provided offerings and contents resides solely with Two Pi Team / Wheel of Games. Any reproduction or utilisation of such graphics, sound documents, video sequences and texts on oher electronic or printed publications is prohibited without an explicit prior consent of Two Pi Team / Wheel of Games. The user is merely allowed to download and print these contents on his own private and non-commercially applicated media or storage media. All further usage like reproduction, distribution or publication is prohibited.
7.1. Two Pi Team / Wheel of Games will not warrant the availability of their services at any time. Two Pi Team / Wheel of Games will not be liable for damage done to the user regardless of its legal ground, in particular for damage resulting from non-availability, delay, interruption or disruptions of services and technical facilities or damage that may originate from incorrect contents, loss or deletion of data, be caused by viruses or differently, except in case of premeditated or reckless action by Two Pi Team / Wheel of Games, their employees or vicarious agents. In case of slight negligence liability is limited to the violation of the material contractual duties as well as to the typical and (at the moment of contract) predictable damage.
7.2. Two Pi Team / Wheel of Games will only be held responsible for illegal content and messages set in Two Pi Team / Wheel of Games sites by users (via discussion forums, chats etc.), in particular for contents that touch third party rights, if Two Pi Team / Wheel of Games should have had prior knowledge of the content and if it should have been technically and economically possible for Two Pi Team / Wheel of Games to suspend this content from further access.
7.3. Two Pi Team / Wheel of Games will not be liable for the correctness, lawfulness, completeness or the intrinsic value of third party offerings. Moreover, Two Pi Team / Wheel of Games will not warrant contentual correctness and completeness of information and data supplied and displayed by third parties on Two Pi Team / Wheel of Games’ sites. Please refer to point 4 of our Terms of Use in this respect.
7.4. Two Pi Team / Wheel of Games is not liable for alien content to which they merely convey usage access (§ 8 TMG). Two Pi Team / Wheel of Games do however point out that there may be an obligation to suspend any access to illicit content within the meaning of the German Teleservices Act regulations, and that Two Pi Team / Wheel of Games will make use of this according to the present stipulations.
Two Pi Team / Wheel of Games commit to observe the legal requirements for data privacy and to respect the communications secret. In this context we particularly refer to the data protection regulations. Provided there is a possibility of indicating personal or business data (e.g. e-mail addresses, names, postal addresses) within internet offerings, their disclosure will always be voluntary. Ulitisation and payment of all offered services – if technically possible and reasonable – are allowed without disclosing any such data and by stating anonymised data or a pseudonym, respectively. By his registration the user agrees to the storage, processing and utilisation of his conveyed data by Two Pi Team / Wheel of Games. The user consents to his voluntarily conveyed information (like date of birth or domicile, etc.) being processed for statistical purposes and being published anonymously on Wheel of Games. The user is at any time entitled to recover his data and, where necessary, to modify or delete it. Third parties are hereby explicitly prohibited to use any contact data, published in the legal notice or in similar statements (e.g. postal addresses, phone and fax numbers or e-mail addresses) for the purpose of transmitting unsolicited informations. In case this prohibition is being violated, Two Pi Team / Wheel of Games expressly reserve the right to undertake legal steps against the forwarders of so-called spam mail. Apart from that, the data protection regulations of Two Pi Team / Wheel of Games apply.
This legal disclaimer should be considered as a part of the internet offerings from which was originally referred to this page. If, for any reason, any formulation or provision of this document or portion thereof is rendered invalid, the remainder of the text will remain in full force and effect.
10.1. Two Pi Team / Wheel of Games reserve the right to modify or endorse these terms of use at any time and without prior notice. Every user undertakes it to regularly check these terms for modifications or additions. With every usage of services/login the user agrees to the version of the terms that is currently in force, unless he should expressly disagree in an e-mail which is to be sent to Two Pi Team / Wheel of Games within 14 days of his having gained knowledge of a modification. To this extent, Two Pi Team will endeavour to point out respective modifications to the user at his login.
10.2. Place of fulfilment and legal domicile for all mutual contractually owed services is the office of Two Pi Team and the competent court.
10.3. This contract is subject to the laws and regulations of the Federal Republic of Germany. Application of the UN Convention on Contracts for the International Sale of Goods (CISG) is foreclosed.
